By accessing or using the Services, you agree to be bound by these Terms; if you do not agree, you must not use the Services.

- Product information and pricing: We aim to ensure that descriptions, availability and prices are accurate, but errors may occur; we may correct any errors and cancel or refuse orders affected by them.
- Order acceptance: Your order is an offer to buy; we accept only when we send an order confirmation or provide access to the purchased item.
- Payment: You authorise us and our payment processors to charge the payment method you provide for the total order amount, including taxes, fees and shipping where applicable.
- Taxes and duties: You are responsible for any applicable taxes, customs duties or other charges not collected at checkout.
6. Shipping, digital delivery and risk
For physical products, risk of loss passes to you when we deliver the order to the carrier.
For digital products, access is typically provided immediately or within a reasonable time after payment is confirmed.
Any delivery timeframes are estimates and not guaranteed, subject to applicable consumer laws.
7. Refunds, returns and cancellations
Your rights regarding refunds, returns and cancellations depend on the type of product and applicable law.
Our current policy is:
- Digital music and downloads: Generally non‑refundable once accessed or downloaded, except where required by law or where the product is defective.
- Merchandise: Returns or exchanges may be offered within a specified period if items are unused and in original condition; shipping costs may not be refundable.
- Tickets: All ticket sales are typically final unless the event is cancelled or rescheduled, in which case remedies will follow the event or ticketing terms.

8. Intellectual property
All content on the Services, including music, recordings, artwork, graphics, logos, text, code, and design (collectively, “Content”), is owned by or licensed to KDOT Records and is protected by copyright and other laws.
Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly perform, publicly display, or exploit any Content without our prior written permission or that of the relevant rights holder.
You may access and use the Services and Content only for your personal, non‑commercial use, subject to these Terms and any applicable license terms (for example, for downloads or streams).
9. User content
If you submit or upload any content to the Services (for example comments, reviews, photos, or other materials), you:
- Grant KDOT Records a non‑exclusive, worldwide, royalty‑free, sublicensable licence to use, reproduce, adapt, publish, translate, distribute and display that content in connection with the Services and our promotional activities.
- Confirm that you own or control the rights necessary to grant this licence and that your content does not infringe any third‑party rights, violate law or breach these Terms.
We may, but are not obligated to, monitor, edit or remove user content at our discretion.
10. Acceptable use
You must not use the Services to:
- Engage in any unlawful, fraudulent, harmful or abusive activity.
- Infringe the intellectual property, privacy or other rights of KDOT Records or any third party.
- Introduce malware or attempt to gain unauthorised access to the Services or related systems.
- Interfere with or disrupt the normal operation of the Services (including by scraping, automated access beyond what is permitted, or excessive load).
We may suspend or terminate your access if you breach this section.
11. Third‑party services and links
The Services may include links or integrations to third‑party websites, apps, platforms or services (including payment processors, ticketing providers, streaming platforms and social networks).
These third parties have their own terms and policies, and we are not responsible for their content, actions or services.
Your use of third‑party services is at your own risk and subject to their terms, not ours.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Services and all Content, products and features are provided on an “as is” and “as available” basis, without any warranties or representations of any kind, whether express or implied.
We do not guarantee that the Services will be uninterrupted, secure, error‑free, accurate, complete or current.
If your local law provides mandatory warranties or guarantees (for example consumer guarantees), nothing in these Terms is intended to exclude or limit them.
13. Limitation of liability
To the fullest extent permitted by law, KDOT Records and its owners, officers, employees, contractors and partners will not be liable for:
- Any indirect, consequential, incidental, special, exemplary or punitive damages.
- Any loss of profits, revenue, data, goodwill or other intangible losses.
- Any damage arising from your use of, or inability to use, the Services, including technical issues, downtime, unauthorised access or alterations to your transmissions or data.
Where liability cannot be excluded under applicable law, our total aggregate liability arising out of or in connection with the Services and these Terms will be limited to the greater of: (a) the amount you have paid to us for relevant products or services in the past twelve months; or (b) [AUD amount you choose].
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law (for example for death or personal injury caused by negligence, or certain consumer rights).
14. Indemnity
You agree to indemnify and hold harmless KDOT Records and its owners, officers, employees, contractors and partners from any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to your: (a) breach of these Terms; (b) violation of any law or third‑party right; or (c) user content or misuse of the Services.

By using the Services, you acknowledge that you have read and understood the Privacy Policy.
16. Changes to the Services and these Terms
We may modify, suspend or discontinue any part of the Services at any time, with or without notice, where permitted by law.
We may also update these Terms from time to time; when we make material changes, we will update the “Last updated” date at the top and may provide additional notice where required.
If you continue to use the Services after changes take effect, you are deemed to accept the updated Terms.
17. Governing law and disputes

You and KDOT Records agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction, except where local consumer laws give you the right to bring claims in your home jurisdiction.

Our failure to enforce any right or provision is not a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, sale of assets or by operation of law.
